EURASIA TRADING INTERNATIONAL (E.T.I), owner of the website accessible to l ́urlhttps://www.reqins.fr/gb/, exclusive owner of the rights to exploit the word and semi-figurative marks "REQINS", "ATELIER REQINS" and "RQS" - hereinafter referred to as "La Marque" or "Les Marques" - and the domain name reqins.fr, makes available to Internet users an online sales website for consumers (hereinafter referred to as "the Users" together) through which it is possible in particular:

  • to identify retailers, distributors of the Reqins® brand, marketing the footwear models of the said brand in a particular place ;
  • order in exchange for the payment of the price the products of the Brand

(hereinafter referred to as "the Site")

It is, for all useful purposes, specified that the designation of the Site means only the "public" part of the Site, the professional interface accessible via the Professional Area being governed by its own Terms and Conditions.

The purpose of these Terms and Conditions of Use (CGU) is to establish the terms and conditions of use of the Site made available to Users. In this regard, Users undertake to respect these CGUs, which act as laws between the parties.

In order to take account of developments in its services, EURASIA TRADING INTERNATIONAL reserves the right to amend these CGUs at any time.

The current online version of these terms of use is the only one that can be relied on throughout the life of the site and until a new version replaces it.

ARTICLE 2 - DEFINITIONS

"User"Means any natural person having legal capacity and using on his own behalf and/or on behalf of a legal person the services on the Site as defined in Article 3 below.

"Customer Account"Means the interface made available to SAS customers E.T.I to enable them, in particular, to monitor their orders, visualize their assets, set up and manage their personal information, especially created at the time of validation of their first order.

"Content"Means any information, text, fixed or animated image, data, sound, models, logos, multimedia file, hyperlink exchanged, communicated and published by SAS E.T.I on the Site and of which she is the sole owner of the exploitation rights.

"CGU"Means these General Conditions of Use.


ARTICLE 3 - ACCESS TO THE SITE

3.1Access to the Site is restricted to adults and minors over the age of 15. The publisher reserves the right to request any justification of the age of his Users.

It is specified that the "Professional" interface accessible to professional SAS customers E.T.I via a unique and personal username and password, is governed by its own general terms and conditions of use which professional customers undertake to become aware of and respect as soon as their account is created.

3.2This being specified, any User undertakes not to use the Site and the information or data contained therein for commercial, political, advertising and any form of commercial solicitation, including the sending of unsolicited emails without the prior consent of SAS E.T.I.

SAS E.T.I reserves the right to refuse access to the service as defined in this Article 5, unilaterally and without prior notification, to any User who does not comply with these Terms of Reference.

3.3For information purposes and without SAS commitment E.T.I as such, it is indicated that the Site is accessible 24 hours a day, 7 days a week, except in cases of force majeure, fortuitous or by a third party, such as those usually retained and defined by the jurisprudence of the French Tribunals. Similarly, SAS E.T.I reserves the right to make any interruption due to the technical maintenance necessary for the proper functioning of the Site and related materials, or to update the Site or for any other reason.

SAS E.T.I reserves the right to suspend, interrupt or limit, at any time and for the duration of its choice (including any final stop) without prior notice, access to all or part of the Site. The User is informed that SAS E.T.I may terminate or modify the features of the services offered on the Site at any time.


3.4SAS E.T.I is not bound by any obligation of result concerning accessibility to the Site, and, in no case, is responsible for any interruptions and consequences that may result.

3.5SAS E.T.I provides its Users with services enabling them to:

- view the Reqins® shoe models ;

- the current collection and possibly previous collections ;

- view "lookbook» the current collection or future collections ;

- view videos of presentation of models or of the Brand ;

- locate merchants, retailers distributors of the Brand, having the selected model, within their trade ;

- identify the address of retailers, distributors of the Brand ;

- use the "GoogleMap®" application to make the route between the location indicated by the User (or the address at which it was geo-located under the conditions defined below) ;

- sign up for the Brand Newsletter ;

- Order – in return for the payment of the price – the products of the Brand

(hereinafter referred to as "the Services")

Access to the Services is free.

3.6All costs associated with access to the Site, whether hardware, software or internet access costs, are borne exclusively by the User. He is solely responsible for the proper functioning of his computer equipment and his Internet access.

(i) Access via a computer

To access Site®, the User must have an internet connection.

The Site and its Services are accessible through an Internet browser. User use and access to services requires an Internet connection and the use of a modern web browser (e.g. the latest versions of Google Chrome, or Mozilla Firefox).

It should be noted that if an obsolete internet browser is used by the User, the quality of the services may be affected, and some features or modules may not work optimally. This deterioration in services cannot be attributed to SAS E.T.I.

(ii) Mobile equipment and accessibility

The Site is accessible in its mobile version from any mobile equipment (smartphone, tablet) via an up-to-date internet browser.

The online app, in its mobile version, is designed to offer Users an optimized experience, which can vary from one mobile model to another, from the size of one screen to another.


ARTICLE 4 - CONTENTS OF THE SITE

All trademarks, photographs, texts, comments, illustrations, animated or non-animated images, video sequences, sounds, as well as all computer applications that could be used to make this site work, and more generally all elements reproduced or used on the Site are protected by applicable intellectual property laws.

They are the full property of SAS E.T.I or its partners.

Any reproduction, representation, use or adaptation, in any form, of all or part of these elements, including computer applications, without the prior written consent of SAS E.T.I, is strictly prohibited and constitutes civil and criminal offences.

The fact for SAS E.T.I not to initiate proceedings upon becoming aware of these unauthorized uses does not constitute acceptance of such uses and waiver of prosecution

The "reqins" / "atelier reqins" / "RQS" and its logos are trademarks registered with the National Institute of Intellectual Property and/or the European Union Office for Intellectual Property, including SAS E.T.I is the sole holder of the exploitation rights. Any total or partial reproduction or such marks without the express permission of SAS E.T.I is prohibited, within the meaning of articles L.713-2 et seq. of the Intellectual Property Code, and is subject to civil and criminal prosecution.

It is as required specified that the models of shoes reproduced on the Site and generallythe models and products of the BrandAre protected by intellectual property law and that any exact reproduction or imitation, without the agreement of the SA E.T.I constitutes an infringement punishable by the provisions of articles L.335-1 et seq. and L.521-1 et seq. of the Intellectual Property Code.

Also, the publisher has the exclusive right to exploit the domain name reqins.fr so that any use of the domain name – in any way – is strictly prohibited.

ARTICLE 5 - SITE MANAGEMENT

For the proper management of the site, SAS E.T.I at any time:

- suspend, interrupt or restrict access to all or part of the site, reserve access to the site, or parts of the site, to a specified category of internet user ;

- to remove any information which may disturb its functioning or which contravenes national or international laws or professional practices ;

- suspend the site in order to make updates.


ARTICLE 6 – RESPONSIBILITIES

The User undertakes not to impede the operation of the Site and Services in any way and in particular not to use a computer program designed to achieve or render unavailable the Site and Services.

Responsibility of SAS E.T.I may not be engaged in the event of failure, failure, difficulty or interruption of operation, preventing access to the Site or any of its features.

Furthermore, the User states that he is fully aware of the characteristics and constraints of the Internet, and in particular of the fact that the transmission of data and information on the Internet has only relative technical reliability, which circulates on heterogeneous networks with various technical characteristics and capacities, which may disrupt access or make it impossible at certain times.

Responsibility of SAS E.T.I may not be engaged in the event of failure, failure, difficulty or interruption of operation, preventing access to the Site, or any of its features. The equipment connecting to the Site used is the sole responsibility of the User. The User should take all appropriate measures to protect his or her own material and data, in particular with a view to protecting against viral attacks via the Internet that would target his or her own data and/or material - The User is solely responsible for the sites and data consulted and stored on his material.

SAS E.T.I may not be held liable in the event of legal proceedings against a User:

- the use of the Site or any service accessible via the Internet ;

- as a result of the User's failure to comply with these terms and conditions.

SAS E.T.I is not liable for damage caused to the User, to third parties and/or his equipment as a result of his connection or use of the Site, which he expressly acknowledges and accepts.

If SAS E.T.I in the event that a User uses the Site for amicable or judicial proceedings, he or she may turn against the User to obtain compensation for any damages, sums, convictions and costs that may arise from the proceedings.

The Site connection material as defined in Article 2 above used by the User to benefit from the Sites and access the Site is the sole responsibility of the User.

The Site may refer - through hyperlinks - to third party applications and sites that may have their own general terms of use and privacy policies, which will govern the use of the Internet users of such third party applications and devices.

SAS E.T.IIs not responsible for the behaviour, functionality or content of any Application, third party device, website or any transaction that the Internet user may enter into with the provider of such Third Party Applications and Devices, nor does the publisher guarantee the continued compatibility or compatibility of Third Party Applications and Devices with the Service.


ARTICLE 7 - HYPERTEXT LINKS

7.1Setting up/inclusion/integration by the User of any hyperlinks to the whole or part of the site is strictly prohibited, unless the publisher has prior written permission, requested by email to the following address: hello@reqins.fr.

SAS E.T.I is free to refuse a link to his services, without having to justify in any way his decision. In case SAS E.T.I the authorisation, it is in all cases only temporary and may be withdrawn at any time, without the obligation of justification on the part of SAS E.T.I.

In any case, any link should be removed on request from SAS E.T.I.

ARTICLE 8 – PROCESSING OF PERSONAL DATA / LAW

In order to enable the exercise of the right of access, rectification, deletion and portability of its personal data by its customers, EURASIA TRADING INTERNATIONAL has integrated a "My Personal Data" tab within the customer area, which allows the Customer (i) to extract directly the personal data stored by the publisher (in the usual formats) and (ii) to modify all personal information on the "My Account" page.

The right to rectification and/or erasure shall be exercised through the contact form or directly by e-mail under the following conditions.

In accordance with the provisions of Articles 38 et seq. of the amended Data Protection Act, all persons whose personal data have been transmitted to SAS E.T.I in connection with the use of the Site or as part of a prospecting campaign have the right to object, access, deletion and rectification of data concerning them. The Internet recognises and accepts that in accordance with the deliberations of CNIL No. 2020-092 of 17 September 2020 adopting a recommendation proposing practical modalities for compliance in the event of the use of "cookies and other tracers", SAS E.T.I informs the user that cookies record certain information that is stored in the memory of their computer hardware/equipment.

The Internet user visiting the homepage of the Site will be informed:

· Specific purposes of the cookies used ;

· The possibility of opposing these cookies and changing the settings by clicking on a link in the banner ;

The product photographs, accompanying their description, are not contractual and do not bind the publisher.

ARTICLE 11 - AMENDMENT OF CGU

SAS E.T.I reserves the right, at any time, to modify or update all or part of the Terms and Conditions of the Site or of sale of the services offered. It is therefore advisable for the Internet user to refer regularly to the latest version of the CGUs permanently available on the Site.

If one or more of the terms of the CGUs are held invalid or declared invalid under a law, regulation or as a result of a final decision of a competent court, they shall be deemed unwritten and the other terms shall remain in force.

ARTICLE 12 - LANGUAGE OF CONTRACT AND APPLICABLE LAW

Only the French version of the EMCs is authentic between the parties and can be produced in court. CGUs are subject to French law.

ARTICLE 13 - COMPETENCE ATTRIBUTION

13.1. Amicable resolution of disputes

In the event of a dispute, the parties undertake, prior to any referral to the judge, to submit their dispute to a (1) court conciliator chosen from among the members of their profession. From the date of his appointment, the conciliator shall have two (2) months to reach an amicable solution to the dispute between the parties. During conciliation, no legal proceedings may be instituted by either party.

If no amicable agreement is reached within the time limit, the competent court may be seized.

In the event of an emergency, in order to put an end to a manifestly unlawful disorder or prevent imminent damage, the parties may always issue an interim summons.

13.2. Jurisdiction

Any disputes relating to the formation, performance and termination of contractual obligations between the parties which cannot be settled amicably shall be submitted to the Tribunalsof Marseilles, subject to a specific attribution of jurisdiction arising from a particular law or regulation.
